El presente escrito explica cuál sería el mejor esquema de responsabilidad civil, en Colombia, para encuadrar aquel siniestro que produce un artefacto de inteligencia artificial. Esto, a partir de un análisis detallado de la IA como concepto general, sus nociones básicas, de posturas relevantes, tanto nacionales como internacionales, que han respondido el problema planteado y de los diferentes esquemas de responsabilidad existentes en el sistema jurídico colombiano. Además, propone la creación de un sistema de responsabilidad sui generis para el problema jurídico planteado y estudiado.
This text explains what would be the best civil liability scheme, in Colombia, to frame the sinister that produces an artificial intelligence artifact. This, based on a detailed analysis of AI as a general concept, its basic notions and the most national and international relevant positions that have responded the problem posed and the different existing liability schemes in the Colombian legal system. In addition, it proposes the creation of a sui generis liability system for the legal problem raised and studied.
